ARTICLE 1 — PURPOSE AND SCOPE

These General Terms and Conditions of Sale (hereinafter the "Terms") govern all sales of jewelry concluded between the company ARADA, a SASU (Simplified Joint-Stock Company with a Sole Shareholder), registered with the Paris Trade and Companies Register (RCS) under number 103 615 225, with its registered office located at 155 rue Saint-Charles, Bâtiment RUE ETG 2, 75015 Paris (hereinafter "ARADA"), and any adult natural person making a purchase on the website www.aradaparis.com (hereinafter the "Customer").

The Terms apply to the exclusion of any other document. They are accessible at all times on the website and prevail, where applicable, over any other conflicting version or document. The Customer acknowledges having read and accepted these Terms before finalizing their order.

ARADA reserves the right to modify these Terms at any time. The applicable Terms are those in effect on the date of the order.

ARTICLE 2 — PRODUCTS

ARADA offers for sale contemporary jewelry handmade in a workshop in Turkey, using brass, silver plating, and gold finishes.

The essential characteristics of each product — materials, dimensions, finishes — are presented on the corresponding product page. The photographs illustrating the products are as accurate as possible but are not contractually binding. Slight variations in shade or texture, inherent to the handcrafted nature of the pieces, do not constitute a defect.

All jewelry offered is in stock and available to order. In the exceptional event of unavailability after an order has been confirmed, ARADA will inform the Customer as soon as possible and offer either a full refund or a substitute product.

ARTICLE 3 — PRICE

Prices are displayed in euros, all taxes included, and include VAT at the rate applicable at the time of the order. Delivery costs are shown separately at checkout and summarized in the order confirmation.

ARADA reserves the right to change its prices at any time. Products are invoiced based on the rate in effect at the time the order is confirmed.

ARTICLE 4 — ORDERING

Placing an order on www.aradaparis.com involves the following steps:

Selecting products and adding them to the cart
Reviewing the cart contents
Entering delivery information
Choosing the delivery method
Selecting the payment method and confirming payment
Order confirmation by email

The sale is deemed concluded once the Customer receives the order confirmation email. ARADA reserves the right to cancel or refuse any order in the event of a dispute relating to payment for a previous order, suspected fraud, or product unavailability.

ARTICLE 5 — PAYMENT

Payment is made online, at the time the order is confirmed, using the following methods:

Apple Pay
Google Pay
Shop Pay
Installment payment via Klarna

Payment is charged immediately upon order confirmation. Transactions are secured using current encryption protocols. ARADA does not retain any of the Customer's banking data.

In the case of installment payment via Klarna, Klarna's specific terms and conditions apply in addition to these Terms. The Customer is invited to review them before selecting this payment method.

If payment is declined by the banking institution, the order is automatically cancelled and the Customer is notified by email.

ARTICLE 6 — PROMOTIONAL CODES

Promotional codes may be offered by ARADA as part of commercial promotions. These codes are valid for a single use, cannot be combined with one another unless otherwise stated, and must be entered at the time of payment. They cannot be applied retroactively to an order that has already been confirmed, nor converted into store credit or a refund.

ARTICLE 7 — DELIVERY

Delivery terms are detailed in the Shipping Policy accessible from the website footer, which forms an integral part of this contract.

ARADA ships exclusively within the European Union. Orders are prepared within 3 to 5 business days from payment confirmation, then shipped via Sendcloud in partnership with Colissimo, Chronopost, or Mondial Relay, depending on the delivery address. Each shipment comes with a tracking number sent by email.

Delivery is free for any order totaling €100 or more, all taxes included.

The delivery times indicated are provided as an estimate. A delivery delay cannot give rise to any penalty or order cancellation, unless the delay exceeds thirty (30) days from the order date, in which case the Customer may request cancellation of the sale in accordance with Article L.216-6 of the French Consumer Code.

ARTICLE 8 — RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to justify their decision or bear any costs other than the cost of returning the item.

To exercise this right, the Customer must notify ARADA of their decision by email at contact@aradaparis.com, stating their order number. The standard withdrawal form, attached to these Terms, may also be used for this purpose.

The product must be returned in its original condition — unworn, unused, with its tags, and in its original packaging — within fourteen (14) days of notifying the withdrawal. Return shipping costs are the Customer's responsibility.

ARADA will refund the full amount paid, including the original delivery costs, within fourteen (14) days of receiving the returned item, using the same payment method used for the order.

Exception — earrings: in accordance with Article L.221-28 of the French Consumer Code, earrings and any jewelry intended to be worn in direct contact with the body are excluded from the right of withdrawal once their protective seal has been removed or the item has been worn, for hygiene reasons. This exclusion is brought to the Customer's attention on the relevant product page, before the purchase is finalized.

ARTICLE 9 — RETURN AND REFUND POLICY

Beyond the legal withdrawal period, ARADA accepts returns up to fourteen (14) days after receipt of the order, provided the product is in its original condition: unworn, unused, with its tags, and in its original packaging.

To initiate a return, the Customer contacts ARADA at contact@aradaparis.com, stating their order number. No return will be accepted without prior approval. Return shipping costs are the Customer's responsibility.

In the case of a defective, damaged item, or one that does not match the order, ARADA will cover the full cost of return shipping and offer, at the Customer's choice, an exchange or a full refund.

ARTICLE 10 — LEGAL WARRANTIES

In accordance with Articles L.217-4 et seq. of the French Consumer Code, every product sold by ARADA benefits from the legal warranty of conformity. In the event of a lack of conformity, the Customer has two (2) years from the delivery of the goods to take action. The Customer may choose between repair or replacement of the goods, subject to the cost conditions set out in Article L.217-9.

The Customer also benefits from the legal warranty against hidden defects, in accordance with Articles 1641 et seq. of the French Civil Code. In this case, the Customer may choose between rescission of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code.

ARTICLE 11 — INTELLECTUAL PROPERTY

All elements of the website www.aradaparis.com — text, visuals, logos, brand names, layout — are the exclusive property of ARADA and are protected by intellectual property law. Any unauthorized reproduction or use constitutes an infringement that may result in the liability of its author.

ARTICLE 12 — PERSONAL DATA

Personal data collected during the ordering process is processed by ARADA in accordance with the GDPR and the French Data Protection Act ("Loi Informatique et Libertés"). For more information, the Customer is invited to consult the Privacy Policy accessible from the website footer.

ARTICLE 13 — MEDIATION AND DISPUTE RESOLUTION

In the event of a dispute relating to an order, the Customer is invited to first contact ARADA at contact@aradaparis.com in order to seek an amicable solution.

Failing an amicable resolution, the Customer may make free use of the consumer mediator designated by ARADA: CM2C (Centre de Médiation de la Consommation de Conciliateurs de Justice), 14 rue Saint-Jean, 75017 Paris — www.cm2c.net

ARTICLE 14 — GOVERNING LAW

These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution or resolution through mediation, the French courts shall have sole jurisdiction.
